A. Introduction

Your privacy is important to NEST INNOVATIVE SOLUTIONS PRIVATE LIMITED (“NEST” or “we”). It is important for you to know the personal data that we collect from you and third parties, why we collect personal data, how we use the personal data and what rights you may have as a data subject or consumer. Please note that all information in this privacy notice is applicable to you unless otherwise indicated in this document, e.g. for US Residents, the section H is applicable in addition to the rest of the terms and conditions. In this notice, term “personal data” is used to represent any information related to an identifiable person and is construed in line with applicable personal data protection legislations such as Information Technology Act applicable in India and California Consumer Protection Act applicable in United States of America.

You should, together with any additional information we may provide to you while collecting or processing personal data on NEST websites, products and/or requests for information, make yourself aware of how and the purpose for which we are processing your personal data. (Please note: We have a different privacy policy applicable between NEST and its employees.)

We reserve the right to change this policy at any given time of which you will be promptly updated in this link/page. If you want to make sure that you are upto date with the latest changes, we advise you to frequently visit and check this link/page.

B. How we will collect and use your personal data

We may collect different types of personal data in different ways and use it for different purposes as detailed herein below:

B.1 To ensure access to our website

In general, you can visit NEST-IS.com and its affiliate websites on the web without telling us about yourself.

Our web servers or Affiliates who provide analytics and other services may collect IP address, operating system, browsing details, device/connectivity details and/or language settings. This information is consolidated to assess the number of visits, average time spent, pages viewed and similar information. NEST uses this information to assess its site usage, improve content and to ensure safety and security as well as improve performance and user experience.

In few situations, you are required to register to access an authenticated area of the website or to download an article: in these cases, we will also collect your name, contact number and email address among others.

We may also obtain data from third parties e.g. social networks, when you allow us to access your data on one or more networks through our website; service providers, who help us to determine a location based on IP address and content to your location; partners with whom we conduct marketing activities.

NEST may use cookies and similar technologies to facilitate proper functioning of our websites and to help collect data.

Please note that our websites may include links to websites of third parties whose privacy practices may be different; if you provide personal data to those websites of third parties, your data is governed by their privacy statements.

B.2 To answer your request for information, support or demonstration

If you contact us with queries, requests for downloading reports or articles, requests for more information about solutions or products, or any other inquiries, we may need to process personal data about you such as personal and contact details, like full name, company and role, email and address, demographic data and your messages.

B.3 Subscriptions to our promotional communications

If you sign up to receive marketing information from NEST, we may send these by email or any other means of communication.

B.4 To promote the NEST brand, products, solutions and values with marketing communications

NEST wishes to promote its brand, products, solutions, and values. Towards that, we process personal data about our business contacts including existing and prospective customers of NEST and third parties with whom NEST interacts while doing business. NEST may collect details about you including name, contact details and other information. We may process this information through software that facilitates us to manage our relationships. We collect such data directly or indirectly from you, or from third parties, such as business partners, data brokers, social networks, marketing companies, and publicly available sources where lawful to do so. NEST may also collect data from emails and calendars when interactions are held with NEST associates.

Your data is used by us in part for administering, managing and developing our business and services; such as identifying existing and potential client business needs, analyzing and evaluating the strength of our interactions with certain business contacts, performing analytics including to produce metrics such as relationship maps for our business leadership and limited profiling for the purposes of helping us to develop and offer appropriate products and services to existing and potential clients. Analytics may be performed by us using algorithms which help us analyze and rank interactions with you depending on interaction frequency and duration. We may also send you marketing communications and surveys to carry out market research or provide information to you about us and our services which we have reason to believe would be of interest to you in your professional capacity.

We may reach out to you through different channels, like email or any other means of communication like social media sites. We will send marketing communications to business contacts in a business context, where either we have your prior consent or where it is otherwise lawful to do so. You can opt-out from receiving these communications at any time using the contact us form on NEST-IS.COM or affiliate websites where you had given your personal data or by emailing to nest.cpo@nest-is2.com or by any other ways available (for example: unsubscribe link in promotional emails when available). We may also utilize this information to promote NEST’ brand.

B.5 To fulfill the obligations of contracts and regulations

Where NEST is in a contractual relationship with you (other than an employment relationship), your employer or your company, we may need to process your personal data, such as name, business contact and job role / title to fulfill the obligations arising from the same contract, such as providing you with the services requested or utilize of the services that you are offering to us.  We will also process such personal data for our daily business activities, such as accounts processing, audit, regulatory reporting or compliance. If you do not provide such information when requested by us in the context of contractual or regulatory compliance, it may delay or prevent us from satisfying your request.

 We will use your personal data for the purposes for which we collected it, in a manner where it is compatible with the original purpose and applicable law. If your personal data is required to be used for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

 For the purpose of compliance to the above, we may process your personal data without your knowledge or consent, where the same is required or permitted by law.

C. How we will share your personal data

C.1 How we will share your personal data with third parties

Third-party service providers (including contractors and designated agents) are referred to as "third parties." Hosting and other internet services, data storage and analytics, marketing research and campaign management and event organizers are examples of third-party service providers.

Your personal data may be shared by us with third parties. However, under any circumstances, NEST has not sold and will not sell your personal data to any third party. NEST does not share your personal data with third parties for any purpose unless there is a legal obligation or a legitimate business purpose permitted by law.

We may disclose your personal data with third parties if we are compelled to do so by law, if it is required for one of the above-mentioned purposes, or if we have another acceptable legal basis for doing so. Third parties must respect the security of your data and treat it in accordance with the law, as required by us. Before sending data to third parties that are not part of the NEST group of companies, we will obtain your consent if needed by law.

All of our third-party service providers are expected to follow our policies and take adequate security measures to secure your personal data. Our third-party service providers are not permitted to use your personal information for their own reasons. We only give them permission to use your personal information for certain reasons and in compliance with our instructions and current legislation. We may also be required to share your personal information with regulators or to comply with the law in any other way.

C.2 Transferring your personal data outside of your country of residence

We may transfer the private data we collect about you to at least one of more countries outside of your country of residence or outside of the country during which you access this website, including India, so as to perform one among the activities listed above (see "How we'll use your personal data"). – In such cases, we've taken acceptable measures to make sure that your personal data are going to be secure consistent with the laws of the country during which you reside. D. How we will keep your personal data safe

We have put in situ appropriate technical, organizational and security measures to stop your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. Additionally, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business got to know. They are going to only process your personal data on our instructions and that they are subject to a requirement of confidentiality. We have procedures to address any suspected data security breach and can notify you and any applicable regulator of a suspected breach where we are legally required to try too so.

E. How long we will keep your information

We will only retain your personal data for as long as necessary to fulfil the needs we collected it for, including for the needs of satisfying any legal, accounting, or reporting requirements. To work out the acceptable retention period for private data, we consider the quantity, nature and sensitivity of the private data, the potential risk of harm from unauthorized use or disclosure of your personal data, the needs that we process your personal data and whether we will achieve those purposes through other means, and therefore the applicable legal requirements. In some circumstances we may anonymize your personal data in order that it cannot be related to you, during which case we may use such information without further notice to you.

For the purposes of the data processed under this statement, the controller or business/service provider for the data processing of your personal data collected through our websites is NEST INNOVATIVE SOLUTIONS PRIVATE LIMITED Limited, India. For all the other purposes indicated above, the controller or business/service provider is that the same entity unless indicated otherwise in other privacy statement communicated in each situation.

G. Right to withdraw consent

In the limited circumstances and supported your country of residence; where you'll have provided your consent to the gathering, processing and transfer of your personal data for a selected purpose, you'll have the proper to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact our DPO (see contacts below). Once we've received notification that you simply have withdrawn your consent, we'll not process your information for the aim or purposes you originally agreed to, unless we've another legal basis for doing so. H. Rights of US Consumers under the CCPA

For residents (consumers) of the United States, once we collect and use personal information about you, we could also be subject to the California Consumer Protection Act (CCPA) and responsible as a ‘business’ or ‘service provider’ for such personal data. Below you'll find the extra specific provisions applicable to you as a resident within the United States; including your rights to your data because it could also be processed by NEST. If the processing of your personal information is subject to the CCPA, you're entitled to the rights listed below.

H.1 Changes to your personal data

It is important that the private data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

H.2 Your rights in connection with personal data

  • Request access to your personal data; this permits you to receive a duplicate of the non-public data we hold regarding you.

  • Request erasure of your personal data; this permits you to raise us, in certain situations, to delete or take away personal data unless our process is specifically allowable beneath the CCPA.

  • Right of revelation available of information or use for business purpose; this permits you to ask us, in certain circumstances, to supply you with your personal data along with the third parties to whom we may have disclosed the information for sale or business purposes. As NEST doesn't sell your personal data, this right could solely apply wherever NEST discloses your personal data for a business purpose.

  • Data portability: This permits you to ask us, in defined circumstances, to produce the personal data you have provided to us during a structured and machine-readable format or to transmit the personal data that you have provided to us to another party.

  • Right to opt-out: This permits you to opt-out of the sale of your personal data by a business to other third parties. As NEST does not sell your personal data, this right does not apply to your personal data with NEST.

  • Right to non-discrimination: This implies that NEST will not discriminate against you in any way or under any circumstance for exercising your rights to your data under the CCPA.

  • Right to withdraw consent: Within the restricted circumstances wherever you may have provided your consent to the collecting, processing and transferring your personal data for a particular purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please send us an email at nest.cpo@nest-is2.com. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legal basis for doing so.

  • Right to equal service and price: if you choose to opt-out of data collection or to restrict access to your information, you will not be subject to penalty such as different prices or to refuse service or sale for the reason of exercising your privacy rights.

If you work out one of the above rights, we might also additionally want to request precise information from you to assist us verify your identification and which you are entitled to make such a request.
